1. Who we are

SurferIQ ("SurferIQ," "we," "us") is an AI-powered surf coaching app operated by SurferIQ LLC, based in New Jersey. You can contact us at surferiq@gmail.com.

2. What SurferIQ does

SurferIQ analyzes video clips of surfing using AI and returns feedback, scores, and training suggestions. SurferIQ is for training and improvement purposes only. It is not professional coaching, does not replace in-person instruction, and makes no guarantee about the accuracy of its analysis. Surfing carries inherent physical risk; SurferIQ's feedback is not safety guidance and should never be treated as such.

3. Who can use SurferIQ

• You must be able to form a binding agreement to these terms, or have a parent or guardian's permission to use SurferIQ if you are a minor.
• If you upload video of a minor who is not yourself, you confirm you are that minor's parent, guardian, or a coach/instructor with permission from a parent or guardian to do so.

4. Acceptable use

By uploading a video, you confirm that:

• The video shows real surfing.
• You own the video or otherwise have the right to upload and share it.
• The video does not contain anything illegal, sexually explicit, violent, harassing, or otherwise inappropriate.
• You will not upload footage of any person without appropriate permission, especially minors.

We may remove content or suspend accounts that violate these terms, at our discretion, without notice.

5. Accounts

• You're responsible for keeping your account credentials secure.
• You may request deletion of your account and associated data at any time by contacting surferiq@gmail.com.

6. AI-generated content

Scores, feedback, and training plans are generated by AI and may contain errors or inaccuracies. Do not rely on SurferIQ as your sole source of coaching or safety guidance. Always use your own judgment, and consult a qualified in-person instructor for safety-critical guidance, especially for beginners and minors.

7. No warranty

SurferIQ is provided "as is," without warranties of any kind, express or implied. We do not guarantee the app will be error-free, uninterrupted, or that its analysis will be accurate.

8. Limitation of liability

To the fullest extent permitted by law, SurferIQ LLC is not liable for any indirect, incidental, or consequential damages arising from your use of SurferIQ, including but not limited to any injury sustained while surfing.

9. Changes to these terms

We may update these terms from time to time. Continued use of SurferIQ after changes means you accept the updated terms.

10. Governing law

These terms are governed by the laws of New Jersey, without regard to conflict of law principles.
